TASTP/TCEQ Q & AFebruary 10, 2009Q. 1) How are proctored sites chosen for the CBT Program? Who makes the decision of CBT locations? A. 1)A TCEQ representative from the training department was not present. The questions will be resubmitted at the next meeting. Q. 2) Is the current rule package for Chapter 334 on schedule? A. 2) Yes. It is scheduled for the February 25, 2009 commission meeting. The adoption package is on the TCEQ website. Q. 3) Are there any changes in the Rule Package going to the Commission on February 25, 2009? A. 3) No. There are no changes. Q. 4) Specifically, what method of test is being requested regarding tightness testing of sumps, man ways and spill containers? A. 4) Spill containers do not require testing. Sumps and man ways should be inspected every 60 days for tightness. Liquid and debris found in spill containers or tank sumps must be removed and disposed of properly within 72 hours. New installations require initial testing and every 3 years thereafter. Q. 5) What record keeping requirements are there for tightness testing for sumps, man ways and spill containers and how long must the records be retained? A. 5) There is no standard form, but records should be kept for a minimum of 5 years. Q. 6) Are there any specific qualifications necessary for the inspector who performs tightness testing of sumps, man ways and spill containers? A. 6) There are no specific qualifications for the inspector. Anybody who has been trained to do the test should follow whatever standard has been established. Q. 7) What happens if a tightness test is missed on sumps, man ways and spill containers? A. 7) A representative from the TCEQ enforcement was not present. This question will be resubmitted at the next meeting. Q. 8) Is Field Operations forcing tank removals now or will they wait to see if the rule changes back to 334? A. 8) No. Q. 9) What are the latest changes in TCEQ personnel in light of the recent reorganization? A. 9) The new director for the Remediation Division is Brent Wade. Section managers and team leaders will be named at a later date. Q. 10) What are the penalties for removing a UST by an unlicensed contractor? A. 10) The penalty is $250.00. This is an issue that needs to be revisited in future rule changes. |
